Terms of Service

1. License

1.1 Grant of a Limited License

Subject to your agreement and continuing compliance with these Terms, Moontech grants you a non‑exclusive, non‑transferable, non‑sublicensable, revocable and limited license to access and use the Service for your own non‑commercial entertainment purposes.

Restrictions

• You shall not create an Account or access the Service if you are under the age of 13; you shall restrict use by minors and deny access to children under the age of 13. You accept full responsibility for any unauthorized use of the Service by minors and for any use of your payment instrument by minors.
• You shall not purchase, sell, rent or give away your Account, create an Account using a false identity or on behalf of someone else; you shall not use the Service if you have previously been removed or banned by Moontech.
• You shall use your Account only for non‑commercial purposes; you shall not use the Service to advertise or transmit commercial messages, including chain letters, junk or spam.

Login Information and Your Account

You may be required to select a password or use other credentials to access your Account ("Login Information"). Do not share your Account or Login Information, nor let anyone else access your Account or jeopardize its security. If you suspect any breach, immediately notify Moontech and modify your Login Information. You are solely responsible for all uses of your Login Information, including purchases.

Moontech may remove or reclaim usernames at any time. The Service supports only one Account per game on a supported device.

License Limitations

Any use in violation of these limitations is strictly prohibited and may result in immediate revocation of your license.

• Engage in any act conflicting with the spirit or intent of the Service or improper use of support services.
• Use cheats, exploits, automation software, bots, hacks, mods or unauthorized third‑party software.
• Modify Service or game files without express written consent; disrupt or negatively affect other users’ experience, including win trading or manipulation of rankings.
• Disrupt, overburden, or assist in disrupting any server used to support the Service or any game environment.
• Launch or assist in attacks, including distribution of viruses or denial of service attacks.
• Attempt to gain unauthorized access to the Service, Accounts, or networks connected to the Service; circumvent security or technology that is part of the Service.
• Post abusive, threatening, obscene, defamatory or offensive information; engage in ongoing toxic behavior.
• Post information containing nudity, excessive violence, or offensive subject matter.
• Harass, abuse, or harm others, including Moontech employees.
• Infringe rights or impersonate any person; make available material that infringes any intellectual property or privacy rights.
• Reverse engineer or derive source code for software used to provide the Service or any Moontech game.
• Solicit Login Information or personal information from other users; collect or post private information of others.

Moontech may take action for violations, including terminating your Account and prohibiting use of the Service.

1.2 Suspension and Termination

WITHOUT LIMITING ANY OTHER REMEDIES, MOONTECH MAY LIMIT, SUSPEND, TERMINATE, MODIFY, OR DELETE ACCOUNTS OR ACCESS TO THE SERVICE IF YOU FAIL TO COMPLY WITH THESE TERMS OR FOR SUSPECTED ILLEGAL OR IMPROPER USE, WITH OR WITHOUT NOTICE.

We may limit, suspend or terminate the Service and Accounts, prohibit access, remove content, and take technical/legal steps to prevent access if we believe users create risk, infringe rights, or act inconsistently with our terms. We may suspend or terminate Accounts of repeat infringers. Moontech may terminate inactive accounts after 180 days.

Moontech may stop offering the Service or a game at any time. Termination may include disabling access to content you or others submitted.

2. Ownership

2.1 Games and Service

All rights in and to the Service and Moontech games are owned by Moontech. Moontech reserves all rights, including intellectual property rights.

2.2 Accounts

YOU HAVE NO OWNERSHIP OR PROPERTY INTEREST IN THE ACCOUNT; ALL RIGHTS IN AND TO THE ACCOUNT ARE OWNED BY MOONTECH.

2.3 Virtual Items

You have no right or title to any content or virtual goods/currency appearing in the Service, whether earned or purchased.

3. User Content

3.1 Submission of User Content

"User Content" includes communications, images, sounds and other material/data you or others upload or transmit through the Service. By submitting, you warrant accuracy, legality, permissions, and freedom from malicious code; and consent to processing per the Privacy Policy.

3.1.1 Content Screening

Moontech assumes no responsibility for user conduct or monitoring the Service for inappropriate content. Your use is at your own risk. Interactions may be monitored/recorded; you consent to such monitoring/recording and acknowledge no expectation of privacy.

Moontech may review, prohibit, edit, delete, or make unavailable any User Content without notice. We may edit, refuse to post, or remove User Content at our discretion.

3.2 Information Use by Others

3.2.1 Public Discourse

Forums, blogs and chats may expose ideas to other members. Do not post confidential information. Moontech has no duty to evaluate, use, or compensate for ideas submitted.

3.2.2 Responsible For Your Own Content

You are solely responsible for information you post. Moontech may reject, refuse to post or delete any User Content.

3.2.3 Your License to Moontech

You grant Moontech a worldwide, perpetual, transferable, royalty‑free license to use, reproduce, modify, distribute, publicly display, perform, and exploit your User Content and derivatives in connection with the Service, including marketing. You grant rights to use your name and likeness and waive moral rights where permitted.

3.3 User Interactions

You are solely responsible for interactions with others. Moontech may, but is not obligated to, get involved. You release Moontech from claims arising from disputes with other users.

4. Fees and Purchase Terms

4.1 Purchases

You may purchase a limited, personal, non‑transferable license to use virtual currency, virtual in‑game items, and other goods/services through the Service.

Moontech may manage, control, modify or eliminate Virtual Items and Merchandise at any time. Transfers are prohibited unless expressly authorized. ALL PURCHASES AND REDEMPTIONS OF VIRTUAL ITEMS ARE FINAL AND NON‑REFUNDABLE.

4.2 Payment of Fees

You agree to pay all fees and taxes. Pricing may change. MOONTECH IS NOT REQUIRED TO PROVIDE A REFUND FOR ANY REASON.

5. Updates to the Service

The Service is evolving. Moontech may require acceptance of updates to the Service and games; third‑party software may need updates to receive the Service and play games.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. MOONTECH DOES NOT WARRANT ACCESS AT ALL TIMES/LOCATIONS, UNINTERRUPTED OR ERROR‑FREE SERVICE, CORRECTION OF DEFECTS, OR FREEDOM FROM VIRUSES. Some jurisdictions do not allow exclusions; certain disclaimers may not apply.

7. Limitation of Liability; Sole Remedy; Indemnification

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOONTECH SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR SIMILAR DAMAGES. MOONTECH’S LIABILITY SHALL NOT EXCEED AMOUNTS PAID BY YOU IN THE SIX MONTHS PRECEDING THE CLAIM. IF YOU HAVE NOT PAID ANYTHING, YOUR SOLE REMEDY IS TO STOP USING THE SERVICE AND CANCEL YOUR ACCOUNT.

Nothing herein affects statutory consumer rights or liability resulting from gross negligence or willful misconduct, or for death or personal injury arising from negligence or fraud.

You agree to indemnify, defend and hold Moontech harmless from third‑party claims arising from your use or breach of these Terms, except where infringement is not attributable to your intentional or negligent behavior.

8. Dispute Resolution and Law

For U.S. residents: governed by California law; claims resolved by courts in San Francisco, California. For non‑U.S. residents: governed by Singapore law; disputes resolved by arbitration administered by SIAC in Singapore, in English, before one arbitrator.

9. Severability

If any portion is found illegal or unenforceable, it shall be ineffective solely to the extent of such determination without affecting remaining provisions.

10. General Provisions

10.1 Assignment

Moontech may assign or delegate these Terms and/or the Privacy Policy at any time. You may not assign without Moontech’s prior written consent.

10.2 Supplemental Policies

Additional policies may apply to specific services; your use is subject to those policies and these Terms.

10.3 Entire Agreement

These Terms, supplemental policies and incorporated documents constitute the entire understanding between you and Moontech.

10.4 No Waiver

Failure to enforce any provision shall not constitute a waiver. No acts or omissions modify these Terms unless documented in a signed physical writing.

10.5 Notices

We may notify you via email or other means. Your notices must comply with this section to have legal effect.

10.6 Equitable Remedies

Moontech is entitled to injunctive or equitable relief without bond in the event of breach or anticipatory breach. You waive rights to seek equitable relief to restrain operation of the Service and agree to limit claims to monetary damages, subject to Section 7.

10.7 Force Majeure

Moontech is not liable for delays or failures due to causes beyond reasonable control, including acts of God, war, terrorism, riots, authority actions, fire, floods, strikes, or shortages.
